1. Who we are
AirCam is operated by Entheos LLC, a limited liability company organized under the laws of the State of Indiana, United States of America ("we", "us", "our"). When you use AirCam, you are entering into an agreement with Entheos LLC.
2. Acceptance
By creating an account or otherwise using AirCam (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be at least 13 years old (or the higher minimum age required in your country, e.g. 16 in parts of the EEA) and, if accepting on behalf of an organization, have authority to bind it.
3. The service
AirCam is an event photo and video collection app for weddings, parties, trips, and team events. You can create an album for an event, capture photos and videos from the app, and invite guests to contribute their own shots via a shared link. We may change, suspend, or discontinue features at any time.
4. Your account
You're responsible for activity on your account and for keeping your credentials secure. You must provide accurate information and keep it up to date.
5. Your content and the license you grant us
You retain ownership of photos, videos, notes, and other content you upload ("User Content"). You grant Entheos LLC a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display your User Content to the people you share it with (album members, link recipients), and to perform the technical operations needed to operate the Service — for example generating thumbnails and video transcodes, taking backups, and running automated abuse / safety checks.
This license does not grant us the right to sell, edit, or distribute your User Content to third parties, or to use it for purposes unrelated to operating the Service, and we do not use your User Content to train AI models or for advertising. The license terminates when you delete the User Content or your account, except (a) for copies that have been shared with other users who have not deleted them, and (b) where retention is required by law or to complete already-initiated technical processes (e.g. backup rotation).
6. Your content warranties
By submitting User Content, you represent and warrant that:
- You own or have all rights, licences, and permissions necessary to upload it and to grant the license in Section 5;
- It does not infringe any intellectual property right, including copyright, trademark, patent, or trade secret;
- It is not defamatory, obscene, harassing, hateful, an invasion of privacy, or otherwise unlawful;
- It will not be used to send spam, conduct unauthorized commercial solicitation, or carry out unlawful activity; and
- You have any consents required from people depicted in photos or videos.
7. Acceptable use
You agree not to: (a) use the Service unlawfully; (b) commit fraud, send spam, or harass others; (c) interfere with the Service's security or integrity (no probing, scraping, malware, or circumventing technical limits); or (d) reverse engineer, resell, or redistribute the Service. We may remove content or suspend accounts that violate these Terms.
8. Reporting abuse
If you encounter User Content or behavior that you believe violates these Terms — including content that is illegal, infringing, or harmful — please report it to support@aircam.me. We review reports and may remove content or restrict accounts. For copyright complaints, please include the information required by the DMCA (or your local equivalent): identification of the work, the location of the material on the Service, your contact details, a good-faith statement, and a signed statement under penalty of perjury.
9. Intellectual property
Entheos LLC retains all right, title, and interest in the Service, including its software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your selected plan.
10. Linking and trademarks
You may link to the Service provided the link is not misleading and does not falsely imply sponsorship, endorsement, or approval. Use of our name, logo, or other branding requires our prior written permission. We may request removal of any link at any time.
11. Payments and subscriptions — Merchant of Record
Our order process is handled by our payments provider, who acts as the Merchant of Record for all our orders and handles payment, billing, taxes, currency, invoicing, and customer service inquiries related to payments. Paid plans bill in advance on a recurring basis until cancelled. Cancellation takes effect at the end of the current billing period. Refunds are handled under our
Refund Policy.
12. EU/UK consumer rights
If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from a digital-content purchase within 14 days. By starting to use or access the purchased digital content immediately on purchase, you expressly consent to immediate delivery and acknowledge that you lose the right of withdrawal once delivery has begun. If you have not yet accessed the content, you may withdraw by contacting support@aircam.me.
Nothing in these Terms removes or limits any mandatory consumer-protection rights you have under the law of your country of residence. EU consumers may also use the European Online Dispute Resolution platform.
13. Suspension and termination
You can delete your account at any time from the profile page. We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On deletion, your content is removed from live systems within 30 days, subject to legal retention obligations.
14. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not guarantee the Service will be uninterrupted, secure, or error-free.
15. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) intentional misconduct or gross negligence; or (d) any other liability that cannot be excluded under applicable law.
Subject to the above, and to the maximum extent permitted by law, Entheos LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, or profits. Our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. For any portion of the Service provided free of charge, our liability is excluded to the fullest extent permitted by law.
16. Indemnity
You agree to indemnify and hold harmless Entheos LLC from claims arising out of your User Content, your use of the Service in violation of these Terms, or your violation of applicable law or any third-party rights.
17. Changes
We may update these Terms from time to time. For material changes we will give at least 30 days' notice in the app or by email before they take effect. Continued use of the Service after the effective date means you accept the updated Terms; if you do not agree, you can delete your account before the changes take effect.
18. Informal dispute resolution
Before starting any legal proceeding, both parties agree to first attempt to resolve the dispute informally by contacting the other and allowing thirty (30) days for a resolution. This Section does not apply to claims for injunctive relief related to intellectual property or unauthorized use of the Service.
19. Governing law and venue
These Terms are governed by the laws of the State of Indiana, United States of America, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in Indiana, USA, and you consent to personal jurisdiction there. If you are a consumer, this Section does not deprive you of the protection of mandatory provisions of the law of your country of residence.
20. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be replaced by a valid provision that most closely achieves the original intent.
21. Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all our assets, on notice to you.
